1. DELIVERY TIMEFRAMES

Estimated Delivery Period
Standard delivery typically occurs within 3–4 weeks following the commencement of Production.

Estimated Only
All delivery timeframes are estimates only and may vary due to factors including (but not limited to):
- custom fabrication requirements;
- powder coating lead times;
- supplier availability;
- delivery location and freight scheduling.

Delivery Notification
Once your delivery date is confirmed by our logistics team or freight provider, you will be notified accordingly.
- While delivery timeframes are estimates only, Goods will be supplied within a reasonable time in accordance with the consumer guarantees under the Australian Consumer Law (ACL). Nothing in this clause limits the Customer's statutory rights.
- AusPatios Direct is not liable for delay or failure to deliver Goods where such delay arises from events beyond our reasonable control, including but not limited to supplier shortages, manufacturing delays, transport disruptions, extreme weather, industrial action, or government restrictions. Nothing in this clause limits rights under the Australian Consumer Law.
2. DELIVERY METHOD & VEHICLE ACCESS

Crane Truck Delivery
Deliveries are carried out using large, heavy-duty crane trucks suitable for transporting roofing and structural building materials.

Access Responsibility
The Customer is solely responsible for ensuring clear, safe, and unobstructed access for delivery vehicles, including:
- adequate street and driveway access;
- sufficient space for vehicle manoeuvring;
- appropriate ground conditions to support heavy vehicles.

Overhead Hazards
The Customer must ensure there are no low-hanging trees, power lines, structures, or other obstructions that could interfere with the crane arm or delivery vehicle.
3. INSULATED VS SINGLE SKIN KIT DELIVERIES

Insulated Kits
To protect materials and ensure logistical efficiency, insulated patio kits are typically delivered in two separate shipments, usually:
- roofing panels; followed by
- structural framing components.

Single Skin Kits
Single skin patio kits are typically delivered in one consolidated delivery, subject to logistics availability.
Split deliveries do not constitute incomplete supply.
4. DELIVERY ATTENDANCE & UNATTENDED DROPS

Attendance Not Required
You are not required to be present at the delivery address on the day of delivery.

Kerbside Unloading
If you are not present, the driver will unload the Goods at the most suitable and safe kerbside location as determined by the driver.

Special Instructions
Any specific site instructions or delivery requirements must be provided to AusPatios Direct at least 48 hours prior to the scheduled delivery date. Instructions provided later may not be accommodated.
- Where Goods are delivered and unloaded in the Customer's absence, risk in the Goods passes upon unloading. The Customer is responsible for securing and protecting the Goods from theft, weather, or damage after delivery, subject to rights under the ACL.
5. PROPERTY DAMAGE & SITE CAPABILITY

Heavy Vehicle Risk Disclosure
Delivery vehicles are large and heavy. By providing a delivery address, the Customer warrants that the site, driveway, and surrounding areas are capable of supporting the weight and operation of a crane truck.

Property Damage
While reasonable care is taken during delivery and unloading, and except to the extent caused by our negligence or breach of the ACL, AusPatios Direct and its third-party carriers are not liable for damage to driveways, turf, gardens, landscaping, underground services, or surrounding property occurring during the reasonable course of unloading.

Safety Override
If the driver determines that driveway or site access is unsafe, unsuitable, or presents a risk of damage or injury, the Goods will be unloaded at the kerbside as the default delivery location.
Nothing in this section excludes liability that cannot be excluded under the ACL.
6. FAILED, ABORTED OR RE-DELIVERIES

Unsafe or Inaccessible Sites
If delivery cannot be completed due to unsafe, obstructed, or unsuitable access, the delivery may be aborted or redirected to a kerbside drop-off at the driver's discretion.

Re-Delivery Costs
Where a delivery is aborted, refused, or rescheduled due to site access issues or customer instructions (and not due to any fault on the part of AusPatios Direct), reasonable additional delivery or re-delivery costs may be charged to the Customer.

Storage & Delay
Delays caused by access issues may result in extended storage or rescheduling, which may impact estimated delivery timeframes.
7. POST-DELIVERY INSPECTION

Immediate Inspection
Upon delivery, the Customer must inspect the Goods as soon as reasonably practicable.

48-Hour Visible Damage Rule
Any visible transit damage or shortages must be reported to AusPatios Direct within 48 hours of delivery to allow prompt investigation and replacement where applicable.

ACL Rights Preserved
This inspection requirement does not limit or exclude the Customer's rights under the ACL in relation to:
- latent defects;
- non-conforming Goods; or
- issues not reasonably identifiable at the time of delivery.
Failure to notify visible damage within 48 hours does not limit the Customer's rights under the ACL in relation to major failures, non-conforming Goods, or defects that were not reasonably identifiable at the time of delivery.
8. RISK & TITLE REFERENCE
Risk in the Goods passes to the Customer upon unloading at the delivery address. Title passes in accordance with the Terms & Conditions of AusPatios Direct.
